1. Agreement to Terms

By accessing metasismedia.com, registering for our services, or providing your phone number to receive SMS or voice communications from us, you agree to be bound by these Terms of Service ("Terms"), all applicable laws and regulations, and our Privacy Policy. If you do not agree, do not use our website or services.

2. Use License

Permission is granted to temporarily download one copy of the materials on Metasis Media's website for personal, non-commercial transitory viewing only. Under this license you may not:

• modify or copy the materials;
• use the materials for any commercial purpose or public display;
• attempt to decompile or reverse engineer software contained on the website;
• remove copyright or proprietary notations from the materials; or
• transfer the materials to another person or mirror the materials on another server.

3. SMS / Text Messaging Terms

We use Twilio Inc. as our service provider to deliver SMS and MMS messages.

Eligibility and consent. SMS messages are sent only to individuals who have registered for our services and expressly opted in to receive text messages from us. By providing your mobile phone number and opting in (whether through our app, website registration, or by another documented means), you consent to receive SMS and MMS messages from Metasis Media at the number you provided. Consent is not a condition of any purchase.

Types of messages. Depending on the preferences you have selected, you may receive transactional and operational messages (such as appointment reminders, confirmations, and account notifications), authentication and one-time passcodes, conversational customer support, and — where you have separately opted in — marketing or promotional messages.

Message frequency. Message frequency varies based on your interaction with our services and the categories of messages you have opted into.

Message and data rates. Message and data rates may apply. Charges are billed by and payable to your mobile service provider. Contact your carrier for details on your messaging plan.

Opt-out. You may cancel SMS messages at any time by replying STOP to any message we send, or by updating your communication preferences in our app. After you reply STOP, you will receive a final confirmation message and you will not receive further SMS messages from us, except where required for transactional purposes that you remain enrolled in. You can resume messaging at any time by replying START or by re-enabling messaging in the app.

Help. For assistance, reply HELP to any message or contact support@metasismedia.com.

Supported carriers and delivery. Wireless carriers are not liable for delayed or undelivered messages. Message delivery depends on your carrier's network and is provided on an as-available basis.

Accuracy of phone number. You agree to provide a phone number that you own or are otherwise authorized to use. You agree to notify us promptly if your phone number changes or is reassigned. You agree to indemnify us against any claims arising from messages sent to a number you previously authorized but no longer control.

Privacy. Our handling of mobile information, including SMS opt-in data, is governed by our Privacy Policy. Mobile information and SMS opt-in data are not shared with third parties or affiliates for marketing or promotional purposes.

4. Voice / Telephone Service Terms

We may place outbound voice calls, delivered through Twilio, to registered users in connection with the services they have signed up for. By providing your phone number and registering for our services, you consent to receive such calls. We do not record or transcribe voice calls. You may opt out of non-essential voice communications at any time by updating your preferences in the app or contacting support@metasismedia.com.

5. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information at the time of registration and to keep that information up to date.

6. Disclaimer

The materials and services on Metasis Media's website are provided on an "as is" and "as available" basis. Metasis Media makes no warranties, expressed or implied, and disclaims all other warranties, including without limitation implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Metasis Media does not warrant that SMS or voice communications will be timely, uninterrupted, or error-free.

7. Limitations of Liability

In no event shall Metasis Media or its suppliers (including Twilio) be liable for any damages — including, without limitation, damages for loss of data or profit, or due to business interruption — arising out of the use of or inability to use the materials on Metasis Media's website or our SMS or voice services, even if Metasis Media or an authorized representative has been notified orally or in writing of the possibility of such damage.

8. Indemnification

You agree to indemnify and hold harmless Metasis Media, its affiliates, and its service providers from any claim, demand, loss, or damages, including reasonable attorneys' fees, arising out of or related to your breach of these Terms, your misuse of our SMS or voice services, or your violation of any law or the rights of a third party.

9. Modifications

Metasis Media may revise these Terms at any time without notice by updating this page. By continuing to use our website or services, you agree to be bound by the then-current version of these Terms.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions, and you irrevocably submit to the exclusive jurisdiction of the courts in that state.
